TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL WISE WIPE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless WISE WIPE, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. 5.4 Order changes and cancellations
If you need to change or cancel an order, contact us promptly. We will assess feasibility based on fulfillment status. Once an order has entered fulfillment, is packed, or has shipped, cancellation and modification may not be possible.
Customizable products cannot be canceled once production has started (after Final Design Approval and payment confirmation).

If you believe there is an issue with a charge, contact us first so we can review and attempt to resolve it. We may provide order, delivery, and communication records to payment processors or financial institutions in connection with a dispute.

6. SHIPPING AND DELIVERY
Shipping and production timelines are governed by the Shipping Policy.

6.1 Delivery estimates
Shipping times are estimates and not guarantees. Delivery may be affected by carrier operations, weather, peak periods, or other factors outside our control.

6.2 Ontario delivery delay cancellation right
For consumers in Ontario, where an agreed delivery date applies, if goods are not delivered within 30 calendar days of the agreed upon delivery date, the consumer may have the right to cancel the agreement and receive a refund as required by applicable law.

6.3 Quebec 30 day delivery rule
For Quebec consumers, if a product is not delivered within 30 days of the date stated in the confirmation (or 30 days from the date of the contract if no date is stated), you may have the right to cancel the order and receive a refund, subject to applicable law.

6.4 Risk of loss and title
Title to the products transfers to you upon full payment. Risk of loss transfers upon confirmed delivery to the shipping address provided in your order, subject to mandatory consumer rights that cannot be waived.

13. BILL 96 COMPLIANCE (LANGUAGE)
For Quebec consumers, where these Terms are considered a contract of adhesion or related documents, a French version must be made available and presented first, free of charge, before an English only version is used. The parties acknowledge that they have requested that this agreement be drafted in English after the French version was made available. 14. FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier disruptions, weather events, labour disruptions, governmental actions, supply chain disruptions, and systems outages.

Except where mandatory consumer protection rules apply (including mandatory Quebec consumer rules for Quebec residents), these Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
